Medical malpractice: Discount plastic surgery a breeding ground

A Florida doctor who was performing discount plastic surgery lost his right to perform surgery after two of his patients died on the operating table. Both patients were to have received liposuction procedures. The first surgery was on February 13, 2010. The patient died the following day. Then again, earlier this summer a second patient died in his office during a liposuction as well, when she went into cardiac arrest. It has been said the doctor was not properly trained in anesthesia or its side effects, and did not have anyone present who was qualified, which are violations of Florida law as well as grounds for medical malpractice claims.

Regrettably, this case underscores important medical malpractice issues. In a largely unregulated area of medicine, doctors with little formal procedure-specific training are performing liposuctions and other plastic surgeries, notwithstanding the fact that they are not board accredited to do so. Increasingly, doctors without proper credentials are advertising for patients. And many of the elective procedures of necessity require Lidocaine, the anesthetic said to be at the root of the two deaths caused by the Florida doctor.

In June, an Arizona doctor was sentenced to 25 years in prison for two counts of second degree murder and one count of manslaughter. Two of those patients died due to anesthetic problems as well, and the third died during a procedure performed by a homeopathic surgeon in the doctor's office. Assistants during the surgeries of the convicted doctor included a janitor and a massage therapist.

Clearly, it is important to ask questions before any medical procedure. Any Florida individual who believes that they or a loved one has been the victim of medical malpractice may benefit by conferring with an attorney. The lawyer can help review the facts and circumstances surrounding the matter, preserve important evidence, and advice on the proper procedure for pursuing legal action against all negligent parties to the fullest extent allowed by law.
