In the Spring of 2011, the Miami Herald published a comprehensive multi-part investigative article on ALF abuse and neglect. It was an attempt to shed light on the deplorable conditions elderly, infirm, and vulnerable Floridians were living in at Assisted Living Facilities across the state. Attorney William A. Dean and the Law Firm of Ford & Dean, P.A., were widely quoted in this comprehensive investigative expose and, in fact, the Miami Herald focused on Ford & Dean’s ALF abuse and neglect trial on behalf of KAREN PAGONO, as Personal Representative of the Estate of FRANCES TREMBLAY, vs. HILLSBORO MANAGEMENT, LLC, d/b/a LIVING LEGENDS RETIREMENT CENTER. William A. Dean & Michael J. Rotundo were successful in obtaining a jury verdict in the amount of $2.4 Million Dollars against the Defendant for the horrific abuse and neglect Frances Tremblay suffered while a resident at the Defendant ALF. As a result of this substantial verdict, William A. Dean & Michael J. Rotundo were introduced into the Daily Business Review’s 2014 Florida Verdicts Hall of Fame.
Since the Miami Herald’s article, one would hope such public exposure would have brought more attention, oversight, and inspection to the ALF industry across the State of Florida. Unfortunately, in the three years since the Miami Herald’s ground breaking investigative expose, the amount of Assisted Living Facilities obtaining licenses from the State of Florida has increased dramatically across the state, as well as the amount of residents residing in Assisted Living Facilities across the State of Florida. During this same time, the State oversight has decreased, and there have been continued attempts to further de-regulate Assisted Living Facilities and dilute the laws to protect Assisted Living Facility residents. Furthermore, during this three-year period, we have seen a disturbing trend which indicates that not only are there more vulnerable and infirm residents being abused and neglected in Assisted Living Facilities, the increased number of Assisted Living Facilities continue to carry little or no insurance. When the Assisted Living Facilities carry little or no insurance, it results in the family members of these victims with very little legal recourse. Notwithstanding this deteriorating and failing system, the Law Firm of Ford & Dean, P.A. continues to aggressively prosecute ALF abuse and neglect cases and seeks to hold not only the defendant ALF, but their owners personally responsible for their misdeeds and abuse.
