Missed diagnosis leads to woman’s cancer death

On Behalf of | Jul 9, 2014 | Failure To Diagnose

Some people get paranoid when they develop a minor cough or sore throat, fearing that it is a sign of something more serious lurking inside of them. However, in many cases, these individuals’ minds are put at ease when they go to the doctor and are diagnosed with a relatively minor medical condition. South Floridians might find it disturbing, though, that sometimes these diagnoses could be inaccurate, leaving them at risk of being overcome by a deadly disease.

This was the center of a recently adjudged lawsuit that awarded nearly $17 million to the family of a woman who died as a result of medical malpractice. The deceased developed a persistent cough and went to see her doctor. After taking and examining X-rays, her doctor told her she had an upper respiratory infection. She was given medication and sent home. About a year later, though, the women returned to the hospital when her condition worsened, and another doctor, who ordered a CT scan, discovered that she had advanced stage lung cancer. The patient died less than a year later. A jury found the doctor who conducted the initial X-ray should have caught the cancer, and therefore found him liable.

A missed diagnosis like this can be devastating for a victim and his or her family. A victim may be forced to live with a painful, life-long medical condition while confronting the fear that the quality and length of his or her life will drastically alter. In addition, a victim and his or her family may suffer extreme financial loss by missing work and attempting to beat the condition through medical means.

Miamians can seek justice and compensation for these losses by filing a medical malpractice lawsuit. An attorney can sit with a victim or his or her family and discuss the steps of the process. Then, if the decision is made to move forward, a victim or his or her family can enter the legal battle with full support.
