Doctor faces claims of surgical medical malpractice

On Behalf of | Feb 28, 2013 | Surgical Errors

Individuals go to the hospital because they have a medical condition that they themselves cannot diagnose and treat. For this reason, patients tend to rely on doctors’ years of training and expertise when deciding what treatment is in their best interest. These treatments often include surgeries. Yet, sometimes doctors give patients the wrong treatment, even performing unneeded operations. When this happens, medical malpractice has occurred.

13 lawsuits have recently been filed against a doctor for performing unnecessary neck and spine surgeries. It was not until the patients went to another doctor that they discovered the operations were not needed. A surgical error like this can leave a patient with serious injuries that can cause permanent disability and the need for long-term care. In the worst cases, a patent can die.

When one is victimized by surgical medical malpractice, she will likely face a long, grueling recovery. This process can take a physical, emotional and financial toll that makes recovery even more difficult. Fortunately, legal action can ease these burdens so that a victim can focus on obtaining a full recovery.

To succeed on a medical malpractice claim, a victim must prove that the doctor owed the patient a duty of care, that duty was breached, and the victim’s injuries resulted from that breach. Once these elements are satisfied, a victim can obtain compensation to cover medical expenses, pain and suffering, and lost wages.

In addition to getting victims the compensation they need and deserve to reach a full, speedy recovery, a successful medical malpractice suit punishes errant medical professionals. Then they will know that negligence will not be tolerated and they will work harder to ensure their services are as a safe as patients expect.
