Nursing home neglect leaves man with septic shock

The purpose of a nursing home is to provide quality care to elderly residents who cannot care for themselves. When families place their loved ones in these institutions, they assume their loved one will be completely safe. Sadly, this assumption is sometimes proven wrong. Nursing home neglect is all too common throughout the country and Florida, with instances also popping up in Miami. Bedsores, rapid weight loss, and a nursing home fall can all be signs of such neglect.

A recently filed lawsuit in Maryland illustrates the dangers posed by a negligent nursing home. The lawsuit was filed against a nursing home after a resident developed a football-sized bedsore that sent the man into septic shock. The resident nearly died from the incident. Luckily, the man survived, but has been in and out of the hospital ever since the incident as his recovery continues.

Individuals who fall victim to nursing home neglect face physical, emotional and financial recoveries. Medical expenses incurred to treat preventable injuries can mount, building stress and limiting resources in a way that can hinder physical and emotional recovery. A lawsuit can remedy this problem.

To succeed on a negligence claim, a victim must prove that the nursing home owed them a duty of care, that the duty was breached, and that the breach resulted in the victim’s injuries. The case in Maryland seems to satisfy these elements. However, determinations of negligence are fact sensitive and require close analysis. But a negligence suit may be the only way nursing home negligence victims can obtain the care they need and deserve.
