Taking legal action when medical care goes beyond consent

A few weeks ago on the blog we discussed battery as it pertains to the medical care setting, particularly surgical errors, and how unwanted treatment can cause significant harm to patients. Unnecessary and unwanted treatments can leave you with a worsened medical condition, including paralysis or even death. However, even if an operation turns out successful, if it is one to which you did not consent, then you may have legal recourse.

As discussed a few weeks ago, battery is any harmful touching that occurs without consent. Therefore, even if an unwanted operation is successful in the grand scheme of your medical condition, you may still suffer harm. For example, you may have scarring and disfigurement, and/or lingering pain. Thus, if your doctor has gone beyond the bounds of your consent, it may be time to speak with an attorney.

The legal team at Ford, Dean & Rotundo know the physical, emotional, and financial pain that can be caused at the hands of medical malpractice. For this reason, our firm passionately and aggressively pursues claims against negligent medical professionals. Though we cannot guarantee an outcome, we strive to provide our clients with the best service and the best possible chance to reach a favorable outcome, considering the underlying circumstances of the case.

Entering the legal process is never fun. It is often necessary, however, to give yourself the opportunity to recover the compensation you need and deserve to reach a full recovery and focus on the life ahead of you. Many times this is a brutal battle, with aggressive defense attorneys protecting hospitals, doctors, and nurses. This is why it is so important to choose your attorney carefully; one who will do everything possible to protect your best interests.
