Medical malpractice claim: Doctors forced woman to have C-section

Florida's expecting mothers may feel a mix of joy and concern before they give birth. They are often excited to meet their newborn child, yet worry about the child's safety as well as her own. In most cases, doctors utilize their training and adhere to the standard of care they owe their patients, resulting in a safe, successful birth. In other cases, though, doctors make critical errors that should never happen, and unsuspecting mothers and their children pay the price.

This is what happened to one woman, and she has since filed a lawsuit against her doctors. According to the lawsuit, the woman, who had had two C-sections in the past, decided to deliver her third child through vaginal delivery. However, upon arriving at the hospital to give birth, the woman's doctors began pressuring her to have a C-section.

It is claimed a doctor even said having a vaginal birth would be like committing child abuse and that her child would be stripped form her. Despite the mother's refusal to consent to a C-section, medical professionals performed one anyway and accidentally cut the woman's bladder in the process. The child, fortunately, was born safely. The woman now seeks compensation for her damages and to punish the hospital and its staff who refused to abide by the woman's wishes.

A hospital mistake or hospital negligence can be deadly. Those who are fortunate enough to get through medical malpractice with their life may still face significant challenges. Physical recovery can be painful and lengthy and finances can become strained. These pressures can also take an emotional toll, leaving a victim overwhelmed with stress, anxiety and depression.

Filing a medical malpractice lawsuit is a very real way for victims to recover their losses and find peace of mind. A Miami-based attorney can help a victim assess the standard of care owed in the situation at hand and whether or not it was breached. If evidence supports a finding that that breached caused the victim's injuries, then compensation may be award to help the victim get back to his or her normal life as best as possible.
