Nursing home neglect leads to resident's death

Many times when families are unable to take care of their elderly loved ones, they place the elderly one in a nursing home where she can receive the constant care and attention she needs. Most of these institutions live up to their duties. Sadly, though, some of these homes fail. These shortcomings can result in bedsores, malnutrition, or a nursing home fall.

A lawsuit has recently been filed against one of these negligent nursing homes. There, a patient who had a history of trying to climb out of bed and falling, fell and suffered head injury as a result. It is claimed that the nursing home's employees failed to properly monitor the victim's medical condition after the fall and failed to get the victim prompt medical care. These delays, it is claimed, resulted in the victim's death.

Instances like this are sad not only because a family is left without a loved one, but also because it was completely avoidable. Preventable nursing home neglect can cause serious injuries and death. Signs of neglect include the existence of pressure sores, rapid weight loss, unexplained bruising, and falls. Injuries from these occurrences can leave victims with a difficult physical, emotional and financial recovery. Families who wrongfully lose a loved one because of neglect also face emotional and financial hardships.

A lawsuit can help victims and their families overcome these burdens. To succeed on a negligence claim, a victim must prove that the nursing home owed the victim a duty of care, that duty was breached, and injury resulted. In cases of death, a surviving family member must establish that the nursing home was negligent and that negligence resulted in the victim's death.

Once successful on a nursing home negligence claim, a victim can obtain compensation for medical expenses and pain and suffering. In a wrongful death case, a surviving family member can also obtain funeral costs. These recoveries allow victims and their families to obtain the quality care they need and deserve so that they can reach a full recovery.
